General Terms and Conditions (GTC)

1. Scope

The following General Terms and Conditions (GTC) apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers.

A consumer is a natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity. An entrepreneur is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contracting parties, conclusion of contract, correction options

The contract is concluded with Danilo Buonafede.

By placing products in our online shop, we make a binding offer to conclude a purchase contract. You can initially place the products in your shopping cart without obligation and correct your entries at any time before submitting your order by using the corresponding correction options during the ordering process. The contract is concluded when you accept the offer for the products in your shopping cart by clicking the order button. After submitting your order, you will receive a confirmation by email.

3. Contract language, contract text storage

The language used for concluding the contract is German. We save the contract text and send you the order details and our General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible online after the order has been completed.

4. Subject matter of the contract

4.1 Product description
The currently valid product description is part of the contract.

4.2 Product images
Please note that due to different screen configurations (e.g., resolution and brightness), slight deviations may occur between the displayed and actual product colors. If you have any questions, please do not hesitate to contact us.

5. Delivery conditions

5.1 Shipping costs
Shipping costs are added to the stated product prices. These are automatically calculated when you enter your delivery address (during checkout).

5.2 Delivery options
We ship the products to the delivery address specified during the order process. Unfortunately, pickup is not possible.

6. Payment

6.1 Prices
The prices indicated at the time of order apply. These prices are total prices.

6.2 Payment methods
In our online shop you can choose from the following payment methods:
• Credit card: Enter your credit card details during the ordering process. Your card will be charged immediately after your order is completed.
• SEPA direct debit: By placing your order, you authorize us to use SEPA direct debit. Your account will be debited before the goods are shipped, and we will notify you at least one banking day in advance.
• Apple Pay: To pay with Apple Pay, you must use the Safari browser, be registered with Apple, and have the feature enabled.
• giropay: For giropay, you need a bank account that supports online banking. Your account will be debited immediately after your order.
• Google Pay: To pay via Google Pay, you must be registered with Google and have the feature activated.
• Klarna: In collaboration with Klarna, we offer various payment methods. To use Klarna, you must successfully pass an address and credit check.
• Paydirekt: You need a bank account that supports online banking to pay via paydirekt.
• PayPal: With PayPal you can pay the invoice amount directly after ordering if you are registered with PayPal.

7. Warranty and guarantees

7.1 Liability for defects
The statutory liability for defects applies.

7.2 Guarantees and customer service
If additional guarantees are provided, you will find further information on the guarantee conditions on the respective product pages and information pages in the online shop.

8. Liability

We are liable without limitation for damages caused by us, our legal representatives or vicarious agents in the following cases:
• in case of injury to life, body or health,
• in the event of intentional or grossly negligent breach of duty,
• in the case of any agreed guarantee promises,
• if the scope of application of the Product Liability Act is affected.

In the event of slight negligence on our part, that of our legal representatives or vicarious agents, we are only liable for damages that are foreseeable and typical at the time of conclusion of the contract. Otherwise, liability is excluded.

9. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here . However, we are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Privacy Policy and Legal Basis for Data Processing

10.1 Data collection and processing
We collect and process personal data exclusively in accordance with legal provisions, in particular the EU General Data Protection Regulation (GDPR). Processing is based on at least one of the following legal grounds:
• Consent (Art. 6 Para. 1 lit. a GDPR): If you give us your consent to process your data, e.g. to receive a newsletter.
• Performance of a contract or pre-contractual measures (Art. 6 (1) (b) GDPR): If processing is necessary to fulfill a contract.
• Legal obligation (Art. 6 Para. 1 lit. c GDPR): If we are legally obliged to process your data.
• Legitimate interests (Art. 6 (1) (f) GDPR): If processing is necessary to protect legitimate interests without your interests overriding them.

10.2 Purposes of processing
Your data will be processed exclusively for the purposes specified in the ordering process, such as processing your order or fulfilling legal obligations.
